What happens on Adjudication meeting Day?

An Adjudication hearing is a document-based process, but the Adjudicator may hold a meeting with the disputing parties before making a decision.
If the adjudicator requires such a meeting, both parties (consumer and involved member) will report at MIDReC at least 15 minutes before the scheduled time

MIDReC staff will verify particulars of both parties (Driving license/Identity)
MIDReC staff will brief both parties on the Adjudication Procedure

Parties are to appear before the adjudicator
Adjudicator will introduce him/herself and explain the ground rules to both parties

Parties each take turns to explain their viewpoints pertaining to the dispute
Adjudicator may clarify and ask for further information with either parties

Adjudicator may issue a written Adjudicator decisions on the same day or after

The decision is final and concludes the adjudication hearing process
If consumer accepts the decision, it is binding on the involved member
If consumers rejects the decision, the process will have no effect on both parties

What happens on Mediation Day?

Both parties will report at MIDReC at least 20 minutes before the session
MIDReC staff will verify particulars of both parties (ie. Driving license/Identity Card)
MIDReC staff will brief both parties on Clause 8 to 27 of the Mediation Procedure

Both parties will be required to sign an Agreement to Mediation before the session can commence.

Parties are to appear before the Mediator
Mediator will introduce him/her and explain the ground rules to both parties

Parties will take turns to explain their viewpoints pertaining to the dispute – Join Discussion
Mediator may clarify and ask for further information with either parties

Mediator may speak to either parties privately – Private Discussion
Mediator may alternate between a Joint and Private Discussion

If a mutually agreeable solution is found, both parties will sign s Settlement Agreement and the session will end there
If both parties cannot reach a settlement, the Mediator will inform MIDReC in writing about the outcome. If they complainant does not want to request for Adjudication, parties may be encouraged to seek legal advice on how to proceed
